Heard learned advocates for the parties. This application is taken out for seeking condonation of delay of 564 days occurred in preferring application for review/ recalling the order passed in Civil Application No. 1705 of 2009 on 10/7/2009, as the workman was saddled with liabilities and could not approach the Court immediately. The workman even preferred LPA in which said appeal was required to be withdrawn as liberty was given for filing review.
The fact remains to be noted is, in delay condonation application though these facts have been mentioned, no affidavit in reply is filed in controverting the same. Hence the delay which has occurred in preferring this application is required to be condoned as the same is in the interest of justice and propriety. Accordingly delay is condoned. Civil Application is disposed of. No order as to costs.
