Heard learned counsel for the petitioners and learned A.G.A. for the State.
It is submitted by learned counsel for the applicants that the present matter relates to a matrimonial dispute between husband and wife and the said matter can be well considered by Mediation Centre of this Court.
It is directed that applicants shall deposit a sum of Rs.10,000/- within two weeks' from today with the Mediation Centre of which 90% shall be paid to opposite party no.2 for his appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the mediation and conciliation proceedings expeditiously, preferably within a period of one month after giving notices to both the parties.
Thereafter the case shall be listed before appropriate Bench.
Till the next date of listing, further proceedings of impugned order dated 17.5.2019 passed by the Additional Sessions Judge, court no.10, Bareilly in criminal revision no.19 of 2019 as well as order dated 17.10.2018 passed by Additional Chief Judicial Magistrate, Room No.8 Bareilly in complaint case no.4600 of 2018, Police station Bhithory Chainpur, District Bareilly, pending in the court of Additional Chief Judicial Magistrate, court no.8, Bareilly shall remain stayed.
After depositing the amount, aforesaid, notices shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, this application shall stand dismissed automatically.
