Heard learned counsel for the petitioner(s) and learned A.G.A. for the State.
This writ petition has been filed with the prayer to issue a writ, order or direction in the nature of mandamus directing respondent no. 2 to forthwith ensure the treatment of the petitioner who is confined in District Jail Badaun and suffering with abdominal/liver problems in S.P.G.I., Lucknow at the expenses/cost of the petitioner.
It has been informed that apparently this is a second writ petition and the first writ petition was earlier disposed of with certain directions.
Keeping in view the facts and circumstances of the case and after hearing learned counsel for the parties and after perusing the averments as made in the instant writ petition, the writ petition is finally disposed of with a direction that in case, petitioner files an appropriate application before the concerned District Magistrate raising all his grievances within a period of one month from today and in case, such an application is filed, the same shall be considered and disposed off within a period of one month thereafter by means of a reasoned and speaking order by the concerned District Magistrate, in accordance with law.
With the aforesaid observations, the instant writ petition is finally disposed of.
