JUDGMENT / ORDER

[1] Rule was issued on 14.05.2012 returnable today. Learned APP was to record statement of the convict and produce before this Court. Learned APP was also requested to take instructions about LIC policy, a copy of which is annexed with the application.
[2] Learned APP has produced statement of the convict recorded on 15.05.2012. The convict has mentioned that he had filed appeal before the Hon'ble the Apex Court, being Criminal Appeal No.987 of 2007 which came to be dismissed by the Hon'ble the Apex Court on 25.01.2011. Now he wants to file appeal before the Larger Bench of the Hon'ble the Apex Court. For that purpose, he has engaged some advocate for whom he has to pay Rs.50,000/- towards fees. For this, the convict wants to withdraw amount from the LIC policy. He has stated that he does not know how much amount is deposited towards his LIC policy.
[3] Learned APP has explained LIC policy of the convict which was taken on 15.01.1997. Table and term is 111-20 i.e. for 20 years. Death benefit under the said policy is Rs.50,000/-. But maturity benefit is Rs.14160/-. Besides that, there will be free insurance cover of Rs.20,000/- and that will continue till 15.01.2027. What is important is that premium payable was quarterly and that was for an amount of Rs.177/-. Date of maturity is 15.01.2017 and last premium to be paid is 15.10.2016. Paltry amount will be payable, if at all, available to the convict.
[5] In view of above, no case is made out for grant of parole leave. Hence, the application is rejected. Rule discharged.
