Ref:- Criminal Misc. Bail Application No. 106581 of 2017 Heard the learned counsel for the appellants and the learned AGA for the State on the bail application moved on behalf of accused – appellant.
In the present case bail is being sought in appeal against the order of conviction.
We have perused the judgment and order dated 13.1.2017 passed by the trial court convicting the appellant.
Learned counsel for the appellant contended that the appellant has been falsely implicated in the present case. He further contended that there is no evidence against the appellant which may show his participation in the alleged crime.
Learned AGA has opposed the prayer for bail with the contention that it is a day light incident; eye-witness account is present and there is direct evidence against the applicant.
Looking to the statement of PW-2 contents of which are self- explicit, no case for grant of any indulgence is made out. The bail application moved on behalf of the appellant is hereby rejected at this stage.
