This application has been filed with the prayer to quash the charge-sheet and the orders dated 12.6.2017 and 18.5.2017 passed by the Additional Chief Judicial Magistrate, Bhadohi, Gyanpur in case no. 2208 of 2017 under Sections 3/7 Essential Commodities Act, P.S. Bhadohi, District Bhadohi Heard learned counsel for the applicant and the learned AGA and perused the record.
It appears that the applicant had earlier approached this Court through application under Section 482 no.29200 of 2017, which was disposed of vide order dated 5.9.2017 extending liberty to the applicant to move discharge application before the Court concerned within thirty days from the date of said order and court concerned was directed to decide the same expeditiously in accordance with law. It was also observed in the said order that for a period of five months or till the disposal of discharge application, no coercive action shall be taken against the applicant. It further appears that the applicant did not comply with the directions given in the said order. Hence, keeping in view the conduct of the applicant, no interference is called for with the matter. There is no infirmity or illegality in the impugned order. The application lacks merits and is liable to be dismissed.
The application is accordingly dismissed.
