1. Heard Sri Rajesh Pandey, learned counsel for applicant-Devendra and Sri Vikas Goswami, learned AGA for the State.
2. This is third bail application filed on behalf of applicant-Devendra. Earlier two bail applications were rejected vide order dated 18.09.2020 when after arguing for some time, learned counsel for applicant had withdrawn the first bail application. Thereafter, second bail application was dismissed on 27.01.2021 on the basis of statements given by the prosecutrix under Section 164 Cr.P.C.
3. Now this third bail application has been filed on the ground that prosecutrix has turned hostile. Reading statements given by the prosecutrix in her examination-in-chief, Sri Rajesh Pandey submits that as prosecutrix has turned hostile, it is a good case to enlarge the applicant on bail.
4. Learned AGA, in his turn, submits that prosecutrix was declared to be hostile witness and thereafter, she was cross examined by the Special Public Prosecutor under POCSO Act. In her cross examination, she has admitted as under:-
“++++++++वि!शेष लोक अभि+योजन पोक्सो एक्ट दे!ेन्द्र का घर मेरे घर के सामने है। बरामद होने के बाद अगले विदन पुलिलस मुझे थाने लेकर गयी थी। पुलिलस ने मेरी डॉक्टरी कराई थी। डॉक्टर साहब को मैंने अपना विनशानी अंगूठा लगाकर डॉक्टरी हेतु सहमतित दी थी। पुलिलस ने मेरा 161 सीआरपीसी का बयान थाने पर लिलखा था मैंने दे!ेन्द्र को विपछली दीपा!ली से जानती हूं। घटना !ाली रात हम जंगल में रूके थे। मेरे साथ जो सम्बन्ध बने थे !ो विबना मेरी मज: के बने थे। मजिजस्ट्रेट साहब के यहां जब मेरा बयान हुआ था तब मैं अके ली थी। जो मैं मजिजस्ट्रेट साहब को बताती रही !ही मजिजस्टेट साहब ने लिलया था यह बयान आज मैं अपनी मज: से ! अपनी स्!ेच्छा से दे रही हूं। मैं हाई स्कू ल पास हो गई हूं। विपछले साल मैंने हाई स्कू ल पास विकया है। घटना !ाले समय में मैं हाई स्कू ल में थी। दे!ेन्द्र का घर मेरे घर के सामने है। जो मैंने 164 सीआरपीसी का बयान मैंने विदया था जो अपनी मज: से विदया था आज जो मैं न्यायालय में कह रही हूं। !ो अपने मन से कह रही हूं। मेरी डाक्टरी हुई थी। पर यह याद नहीं है विक कहां हुई थी। डॉक्टरी के बाद से कचहरी मजिजस्ट्रेट साहब के यहां बयान देने आई थी। मेरे साथ मविहला आरक्षी थी। मजिजस्ट्रेट साहब +ी मविहला ही थी। मजिजस्ट्रेट साहब ने बयान लिलखने से पहले कहा था विक डरो मत जो कु छ हुआ है सही सही बताओ। तब मेरे जो मेरे साथ हुआ था सही सही बताया था तब मैंने 164 सीआरपीसी के बयानों पर हस्ताक्षर लिलये थे।"

Placing reliance on such cross examination, Sri Vikas Goswami, submits that there is sufficient material to convict the accused and since prosecutrix has supported the case of the prosecution in her cross examination after being declared hostile, then it cannot be said that applicant-Devendra is innocent and he can be enlarged on bail.

After hearing learned counsel for the parties and going through the record, especially, the statements given by the prosecutrix before the court concerned in her examination-in-chief and cross examination which has been extracted above, I am of the opinion that involvement of the present applicant-Devendra has been clearly made out in violating the physical, emotional and psychological privacy of a minor girl, who is admittedly a minor. Therefore, there is no new ground/change of circumstances to enlarge the applicant on bail, thus application fails and is dismissed.
