Supplementary affidavit and counter affidavit has been filed taken on record.
Learned counsel for the applicant submitted that since the marriage of applicant's sisters is going to be held on 06-02-2010, hence the prayer to release the applicant on parole to attend the marriage may be allowed. The applicant is in jail since 15.05.2009.
In view of the fact let the applicant Devendra Tarkar be released on a short term bail for a period of 30 days, on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No. 312 of 2009 under Sections 363, 366 and 376 I.P.C. Police- Station Farah, District-Mathura. After expiry of the aforesaid period the applicant will surrender and file a copy of surrender certificate.
Let a copy of this order be issued to learned counsel of the applicant on payment of usual charges today.
