1. Heard Sri Brij Raj, learned counsel for the petitioner, Sri Mahboob Ahmad, learned counsel for respondent nos. 2 to 4 and learned Standing Counsel for the State.
2. Grievance of the petitioner that he has applied for electrical connection but the same has not been provided till date by the Authority concerned.
3. Learned counsel for the respondent nos. 2 to 4 states that petitioner has an alternative remedy to file appeal before the Authority.
4. If there is any dispute with respect to correctness of electricity dues, petitioner had a statutory remedy of filing objection under para 6.5 of Uttar Pradesh Electricity Code, 2005 (hereinafter referred to as 'Code'). If decision taken by Executive Engineer on such representation / objection is not to the satisfaction of petitioner, he has further remedy before District Consumer Grievance Redressal Forum under para 7.10
(i) of Code read with U.P.E.R.C. (Consumer Grievance Redressal Forum & Ombudsman) Regulation 2003 (hereinafter referred to as 'Regulation 2003') and thereafter remedy is provided before Ombudsman under para 7.10 (iv)of the Code.
5. In view thereof, writ petition is dismissed on the ground of alternative remedy to petitioner.
