Heard Mr Anant Ram Gupta, learned counsel for the petitioner, Mr Deepak Mishra, learned AGA and perused the record.
This petition has been filed by the petitioners with a prayer to quash the F.I.R. dated 27.4.2018 registered as case crime no. 1605 of 2017, under sections 420, 467, 468, 471, 506 IPC, P.S. Kotwali City Etah, District Etah.
It is contended by learned counsel for the petitioner that petitioner is informant of the case in which after investigation charge sheet has been submitted upon which cognizance has been taken by the concerned Magistrate but the S.S.P., Etah has ordered further investigation into the matter under Section 173(8) Cr.P.C., which is stated to be pending.
Considering the facts and circumstances of the case, but without prejudice to the merits of the case, the writ petition is disposed off with the direction to the S.S.P., Etah to ensure that the further investigation as ordered by him is concluded within a period of six months in accordance with law from the date of production of certified copy of this order.
