Heard learned counsel for the petitioner and the learned Standing Counsel for the State respondents.
The sole ground on which the order of transfer is assailed is that the same has come to be made in breach of the provisions made in Regulation 36(b) of the U.P. Primary Agriculture Cooperative Credit Societies Centralised Service Rules 1976. It is contended that a member of the centralised service could not have been transferred before rendering five years of continuous service in one society. According to the petitioner he has been frequently transferred in breach of the aforesaid regulation. The aforesaid submission is made without bearing in mind the language employed in that regulation namely of a transfer “ordinarily” not being made before completion of five years in a particular cooperative society. That itself indicates that the prescription is not mandatory. In view of the aforesaid, the challenge to the order of transfer fails.
The writ petition stands dismissed.
