JUDGMENT / ORDER

Heard learned counsel for the applicant.
The applicant alleges non-compliance of the order of writ Court dated 20.02.2014 passed in Writ Petition No. 1095 (S/S) of 2014 (Devendra Singh Katiyar Vs. State of U.P. and others), whereby while allowing the writ petition, writ Court directed the opposite parties to pass appropriate order for payment of arrears of salary to the applicant for the period August 2001 to 22.02.2004 along with periodical increments and other admissible service benefits which were due to petitioner/applicant, expeditiously, say within a period of three months from the date a certified copy of order is produced before them.
Submission of learned counsel for the applicant is that copy of the order of writ Court was served upon opposite party through proper channel on 07.04.2014 followed by reminder on 24.04.2014 and thereafter through register post on 13.06.2014. It is also submitted that time prescribed by the writ Court has already expired, but no action has been taken by the opposite party in compliance of the order of writ Court.. Therefore, the applicant is constrained to approach this Court by means of present Contempt Petition for initiating proceedings against opposite party under the provisions of Contempt of Court Act for willful disobedience of the order of Writ Court dated 20.02.2014.
On due consideration, prima facie, a case of willful violation of the the order of writ Court is made out.
Let notice be issued to opposite party to appear before this Court on 11.08.2014 to show cause as to why proceedings be not initiated against him under the provisions of Contempt of Court Act for willful disobedience of the order of writ Court dated 20.02.2014 passed in Writ Petition No. 1095 (S/S) of 2014 (Devendra Singh Katiyar Vs. State of U.P. and others).
It is provided that if order of the writ Court is complied with and compliance report is filed, the opposite party need not appear before this Court on the date fixed.
