Heard Sri Ashok Kumar Yadav, learned counsel for the petitioner and learned Standing Counsel for respondents State.
Earlier on 12.08.2020, following order was passed:-
"Allegation is that although the order was passed as back as on 9.11.2020 but till date no action has been taken.
Learned Standing Counsel may seek instructions in the matter. Put up this case as fresh on 21.9.2021."
From the perusal of the record, it appears that the present petition has been filed seeking a direction for initiating proceedings under Section 95(g) of the U.P. Panchayat Raj Act against respondent nos. 5 to 7 for misappropriation of funds for the year 2019-20.
As the election for Gram Pradhan has already been held in the month of April, 2021, writ petition filed for initiating enquiry against ex-Pradhan, respondent no. 5 is not maintainable as no proceeding can be initiated against an ex-Pradhan.
In view of above, writ petition stands dismissed.
