Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C., has been filed for quashing non bailable warrant dated 31.07.2018 passed by Additional Chief Judicial Magistrate, court no.13, Agra in complaint case no.7072 of 2014, under Section 138 N.I.Act, P.S. Achhanera, District Agra.
Learned counsel for the applicant has made limited prayer that the applicant is willing and ready to appear before the court below on 06.02.2019 along with appropriate application.
Learned A.G.A. has not contradicted the prayer made by the learned counsel for the applicant.
In view of the facts and circumstances of the case, this application is disposed of with direction that the applicant shall appear on or before 06.02.2019 before the court concerned along with appropriate application and the same shall be decided expeditiously, preferably within two months from the date a certified copy of this order is produced before it.
Till 06.02.2019 non bailable warrant dated 31.07.2018 shall be kept in abeyance.
If the applicant fails to appear on 06.2.2019, the court below is directed take coercive steps for procuring the appearance of the applicant.
With the aforesaid direction the application stands disposed of.
