This writ petition has been filed inter alia for the following relief:
"(ii) Issue a writ , order or direction in the nature of mandamus directing the respondents to provide pension in favour of applicant under the provision of Freedom Fighters' Pension Rules."
Learned counsel for the petitioner states that the father of the petitioner, being a Freedom Fighter, was getting pension and he died on 18.2.2013. He further submits that after his death , the respondent no. 3 issued certificate in favour of the petitioner certifying that he is 80% handicapped. He further submitted that the petitioner is entitled to get pension under the Scheme of Freedom Fighters' Pension Rules and in this regard he has moved an application before the concerned authority and the same is still pending.
Learned Standing Counsel submits that since the petitioner is major he is not entitled to get pension under the Freedom Fighters' Pension Rules and the writ petition is liable to be dismissed outrightly.
We find substance in the submission so made by the learned Standing Counsel.
In view of the above, we do not see any justification to interfere in the matter.
The writ petition, being misconceived, is hereby dismissed.
