Court No. - 33
Case :- FIRST APPEAL DEFECTIVE No. - 339 of 2018 Appellant :- Devendra Kumar Respondent :- Smt. Anju Counsel for Appellant :- Atul Kumar Counsel for Respondent :- Mohd. Akbar Shah Alam Khan,Mohd. Naushad Siddiqui Hon'ble Manoj Misra,J.
Hon'ble Rohit Ranjan Agarwal,J.
We have heard Sri Atul Kumar for the plaintiff-appellant; and Mohd. Akbar Shah Alam Khan for the defendant-respondent.
The instant appeal has been filed against the order dated 25.07.2018 passed by the Principal Judge, Family Court, Muzaffar Nagar by which maintenance pendente lite at the rate of Rs.3000/- and lump sum litigation expenses of Rs.8,000/- has been awarded to the defendant-respondents.
We have perused the order passed by the court below. It appears from the record that the marriage is admitted and two daughters have also been born out of the wedlock. The appellant has not shown that the respondent has any other source of income. Otherwise also, since the amount of maintenance is meagre which about Rs.100 a day, we do not find any good reason to interfere with the order passed by the court below. The appeal is dismissed.
