The petitioner is seeking a direction to the respondents to permit him to appear in the interview for the post of Gram Panchayat Adhikari. In para 11 of the writ petition, it is stated that the petitioner has done Diploma in Computer Science from Maharishi Dayanand College of Computer Science, sponsored by Maharishi Dayanand Education Group, Annexure-2 to the writ petition.
Sri K.S. Kushwaha appearing for the respondents submits that Diploma in Computer Science has not been found as being equivalent to Computer Concept Course (CCC) issued by DOEACC society. It is stated that view taken by the learned Single Judge of this Court in Writ Petition No.48351 of 2016 has also been affirmed with dismissal of Special Appeal (Defective) No.750 of 2016, decided on 8.12.2016 Admittedly, petitioner appears to have obtained certificate from a private institution and in any case is not recognized by the Government of U.P. nor can it be said to be equivalent to the Computer Concept Course (CCC) certificate issued by the DOEACC Society, which is the requisite qualification for the post in question. Therefore, in view of the law laid down by this Court in Writ petition no.30313 of 2016 (Abha Tripathi and others Vs State of U.P. and others), since the petitioner does not possess the requisite qualification of CCC Certificate from the DOEACC Society, it cannot be said that he possesses the requisite eligibility qualification as per the advertisement for the post of Gram Panchayat Adhikari.
This writ petition lacks merit and is accordingly, dismissed.
