Petitioner is claiming family pension after death of his wife. Petitioner's wife was appointed as Shiksha Mitra and her services were absorbed as Assistant Teacher. It appears that petitioner's wife thereafter died on 24.6.2015 and a claim for grant of family pension has been raised.
The issue of absorption of Assistant Teachers has ultimately travelled to the Apex Court and such absorption has been set aside. The Apex Court found that the Shiksha Mitra has no such right to be absorbed. In such circumstances, appointment of petitioner's wife would not constitute any basis for family pension to be claimed by the petitioner.
Writ petition lacks merit and is dismissed.
