Heard Sri Bheshaj Puri, learned counsel for the petitioner and Sri K.D. Singh Rathore, learned counsel for the electricity department.
Against the electricity theft a provisional assessment was made on 5.5.2016. Against the provisional assessment, the petitioner has filed objection on 4.6.2016. That objection has not yet been decided and recovery certificate has been issued for a sum of Rs. 2,74,669/- and other charges on 5.8.2017.
Learned counsel for the petitioner submits that without deciding the objection, the electricity department is pressing for recovery and harassing the petitioner.
The writ petition is disposed of with the direction to the Executive Engineer to consider the objection of the petitioner dated 4.6.2016 and pass appropriate order there on in accordance with law as far as possible within a period of one month from the date a certified copy of this order is presented before it.
