Heard learned counsel for the applicant, Sri Neeraj Singh, learned counsel for opposite party no. 2 and learned A. G. A. for the State.
The present application has been filed being aggrieved against order dated 24.07.2019 passed by the concerned court below in S. T. No. 498 of 2000, arising out of case crime no. 465 of 1990, by means of which the application filed by the prosecution under Section 311 Cr.P.C. has been rejected.
Learned counsel for the applicants contended that the order impugned has wrongly been passed.
I have perused the order impugned dated 24.7.2019 which shows that the application has been rejected by means of a speaking and reasoned order. Relevant portion of the order is quoted herein as under:

The findings as extracted above are based on a clear appreciation of law to which no illegality or perversity has been attributed by the learned counsel for the applicant.
Thus, in view of the aforesaid facts and circumstances, no case for grant of any indulgence is made out.
Accordingly, the application is rejected.
