The present petition has been filed for a direction upon the respondent no.2 to consider the prayer of the petitioner for grant of arms licence as well as for transfer in his favour of the weapon held by his father's elder brother.
The learned Standing Counsel has submitted that the petitioner may not fall in the specified category for seeking such transfer. However, the prayer of the petitioner for grant of licence can be considered in accordance with law.
In view of the above, without expressing any opinion on the merits of the claim of the petitioner, the petition is disposed of by giving liberty to the petitioner to file a comprehensive representation before the Licensing Authority / District Magistrate, Kanpur Nagar (second respondent) annexing therewith copy of the licence grant application submitted by the petitioner. If any such representation is filed along with certified copy of this order as well as necessary documents by disclosing that all formalities for grant of licence have been completed by the petitioner, the Licensing Authority shall call for report from the authorities concerned and after examining the facts available on the record shall take an appropriate decision in accordance with law, preferably, within a period of two months from the date of filing of such representation.
