Devesh Kumar Maurya vs State Of U P And Others

High Court Of Judicature at Allahabad|06 June, 2019
|

JUDGMENT / ORDER

Court No. - 32
Case :- WRIT - A No. - 9542 of 2019 Petitioner :- Devesh Kumar Maurya Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Dheeraj Kumar Yadav Counsel for Respondent :- C.S.C.
Hon'ble Saurabh Shyam Shamshery,J.
Heard Sri Dheeraj Kumar Yadav, learned counsel for petitioner and learned Standing Counsel for State respondents.
Sri Dheeraj Kumar Yadav, Advocate appearing on behalf of petitioner submitted that petitioner is a Pharmacist who is working at Primary Health Centre. Learned Counsel further submitted that presently process of regularization is being undertaken and counselling for that purpose is fixed on 06.06.2019 and 07.06.2019. However, the name of the petitioner is not in the list issued for that purpose.
In the Government order whereby the counselling has been fixed, it is clearly mentioned that Pharmacists who have passed diploma in pharmacy in the year 2002, only would be called for counselling. Admittedly, the petitioner has passed the course of pharmacy in the year 2003. Therefore, he is not eligible for the counselling. Counsel for the petitioner has not able to dispute this factual aspect.
Therefore, no case is made out for any interference by this Court in exercise of powers under Article 226 of Constitution of India.
This writ petition is misconceived and is dismissed accordingly.
