THIS CRL.P COMING ON FOR HEARING THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R Learned counsel for the petitioner is absent when the matter is taken up for hearing.
2. Learned SPP has filed a memo dated 25.01.2019 which reads as under:
“It is submitted that the Petitioner herein had sought quashing of the F.I.R. registered in Crime No.94/2013 (arising out of PCR No.142/2013) of Bhadravathi Old Town Police Station, Shivamogga District for the offences punishable under Secs. 217, 288, 504, 505 & 506, I.P.C. and it is reported by the Police that they have conducted investigation and submitted B-Report on 18.02.2014 to the Court of the learned II Addl. Civil Judge & J.M.F.C., at Bhadravathi and the same has been accepted on 20.08.2015.
It is prayed that this Hon’ble Court be pleased to take the Memo on record in the above case and pass appropriate Orders, in the interest of justice and equity.”
3. Memo is placed on record. In view of the said memo, the petition does not survive for consideration. Accordingly, the petition is dismissed.
