Devesh Chandra Mathur vs Union Of India And Anr

High Court Of Judicature at Allahabad|20 December, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 29590 of 2002 Petitioner :- Devesh Chandra Mathur Respondent :- Union Of India And Anr Counsel for Petitioner :- I.B. Singh
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioner.
2. By means of the present writ petition, petitioner has sought the following reliefs:
"(i) Issue a writ, order or direction in the nature of certiorari quashing the order dated 20.4.99 (A-8) by which the request of the petitioner for making the payment of entire post- retiremental benefit has been refused.
(ii) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to make the payments of all entire post-retiremental benefits to the petitioner i.e. salary for 25 months, Travelling Expanses for January, 94 to Nov. 97, Bonus for 3 years, encashment of privilege leave for 80 days and payment of illegal deduction with the interest of 18% a year as the petitioner's offer for voluntary retirement was accepted by the respondent, and as there is order of deduction of any salary of the petitioner till date."
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
