The petitioners in all these writ petitions are having grievance against the notification issued under section 4(1) of the Land Acquisition Act, 1894 (for short the 'Act') for establishing the Indian Institute of Information Technology in Vallichira Village. Essentially, it is being challenged alleging mala fides. They also have other grievances against the proceedings initiated for land acquisition. Their apprehension is that they would be deprived of the invaluable right to raise their objections. However, the learned Senior Government Pleader, on instructions, submitted that the petitioners would be afforded with an opportunity of being heard in accordance with the provisions of law and therefore, the apprehension of the petitioners is baseless. In view of the said submission to the effect that acquisition proceedings would be pursued strictly in accordance with law and at the appropriate time and the petitioners would be given an opportunity to raise all their objections and in case of any objections, such objections would be considered in their true perspective I do not think it necessary or expedient to consider the contentions on merits, at this stage. Taking stock of the situation, the learned senior counsel appearing for the petitioner in W.P.(C).No.5780 of 2013 and the learned counsel for the petitioners in other writ petitions sought permission to withdraw the writ petitions without prejudice to the right of the petitioners to resort to appropriate proceedings, in case of necessity, at the appropriate stage. In such circumstances, these writ petitions are dismissed as withdrawn with the said liberty. It is made clear that all the contentions are left open.
