Mr.Pandya, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to attend marriage ceremony of his niece, which is fixed on 28.1.2012.
This Court has already passed the order for releasing the applicant - convict on temporary bail for the performance of the post death ceremony on account of the death of his father in Criminal Misc. Application No.192 of 2012. The ground for attending marriage ceremony is not such where his presence can be said to be indispensable.
Hence, the discretion does not deserve to be exercised. Therefore, the application is rejected. Rule discharged.
