Heard Ms. Farzana Jamal, holding brief of Sri S.K. Tyagi, learned counsel appearing for the applicant and the learned Standing Counsel appearing for the State - respondents.
Present contempt application has been filed with a prayer to punish the opposite party/contemnor for willful disobedience of the order dated 22.12.2010 passed by this Court in Matters under Article 227 No. 1268 of 2010.
The order dated 22.12.2010 is quoted as under:
"Heard learned Counsel for the petitioner.
Learned Counsel for the petitioner states that the interim matter in appeal no. 61 of 2010 is pending consideration and the next date fixed in the Court below for deciding the same is 3rd of January, 2011.
In view of the above, the Court below is directed to proceed in the matter on merits and in accordance with law on the date so fixed by it.
It is made clear that neither party shall be granted any frivolous adjournment.
Till 3rd of January, 2011 parties shall maintain status-quo as on today. The writ petition is disposed of as above."
Learned counsel for the applicant states that now the matter has become infructuous.
This contempt application is, accordingly, dismissed as having become infructuous.
