Petitioner has approached this Court with the grievance that Committee of Management by misrepresenting facts has secured promotion for respondent nos.6 and 7 on the post of Lecturer, and they are being paid salary contrary to law. According to petitioner the post against which promotion has been made was of Assistant Teacher, and therefore promotion to the post of Lecturer was impermissible. A grievance in that regard has been raised by the petitioner before the Director, and it is alleged that certain enquiry has also been made. Attention of the Court has been invited to a communication sent by the District Inspector of Schools, Mau dated 24.9.2018, as per which the enquiry report has been forwarded to Director of Education (Secondary). Grievance is that despite such report sent, no further action is being taken in the matter.
Learned Standing Counsel states that appropriate decision in the matter would be taken by the competent authority, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.2, in respect of his grievance annexing all relevant materials in support of his claim, alongwith certified copy of this order, within two weeks from today. The Director concerned shall examine petitioner's grievance, in light of the communication sent by the District Inspector of Schools, Mau, dated 24.9.2018. An opportunity of hearing would be afforded to respondent nos.5, 6 and 7 also. The Director shall pass suitable orders, as may be warranted in law, in light of the facts, noticed above, within a period of four months.
