Common Order:
A.S.No.294 of 2009 is filed against Judgment and Decree, dated 21-11-2008, in OS.No.610 of 2004, on the file of the Court of the learned IV Additional Senior Civil Judge, Guntur.
Pending the above appeal, the appellants filed ASMP.No.519 of 2014 for allowing the appeal in terms of the compromise entered between the parties. The original compromise deed is signed by the appellants as well as the Director of the respondent. In the said compromise deed, it is stated that the respondent agreed to receive a sum of Rs.20,90,065/- towards the advance amount paid under Ex.A.2 along with compensation and costs; that the said amount was already paid by the appellants to the respondent; that the respondent agreed that the appellants are entitled to withdraw a sum of Rs.3,09,935/- deposited by it, on 05-12- 2008, to the credit of the suit in the lower Court as the balance sale consideration and that the respondent has no objection for setting aside the Judgment and Decree under appeal.
Though the Counsel for the parties are not present at the hearing, in view of the compromise memo filed by both the parties in ASMP.No.519 of 2014, the said application as well as AS.No.294 of 2009 are allowed and the Judgment and Decree, dated 21-11-2008, in OS.No.610 of 2004, on the file of the Court of the learned IV Additional Senior Civil Judge, Guntur, is set aside.
As a sequel, ASMP.No.898 of 2009 is disposed of.
