THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri.Mujtaba H., learned counsel for the petitioner.
2. Learned counsel for the petitioner seeks leave of this Court to withdraw the petition with liberty to approach the State Information Commission.
3. In view of the aforesaid submissions, the petition is disposed of with liberty to the petitioner to approach the State Information Commission. Needless to state that in case the petitioner files an appeal before the aforesaid Commission within a period of three months from today, the Commission shall invoke the principles contained under Section 14 of the Limitation Act, 1963 and shall decide the appeal preferred by the petitioner after affording an opportunity of hearing to all the parties by a speaking order, expeditiously. It is made clear that this Court has not expressed any opinion on the merits.
