THIS CRIMINAL PETITION IS COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Petitioner No.1 – Mr.Dev Ramanna, Petitioner No.2-Smt.Vijayalakshmi Ramanna and their counsel Sri. Vijaykumar Prakash and the respondent - Sri. Balaram M.L. party-in-person are present.
2. Petition is filed under Section 482 of Cr.P.C. seeking to quash the order dated 22.02.2011 in PCR No.3846/2011 whereby the VI Additional Chief Metropolitan Magistrate, Bangalore, has taken cognizance of the offences punishable under Sections 418, 420 r/w 34 and 120(B) of IPC.
3. The parties have filed a Joint Memo duly signed by the petitioners and the respondent and their respective counsels wherein it is stated that the disputes between the parties are amicably settled in the Lok Adalat on 29.08.2018 and in terms of the said settlement, the respondent (party-in-person) has withdrawn all the allegations made against the petitioners leading to the registration of the above FIR. Both the parties submit that the terms of the aforesaid Joint Memo are true and correct and they have entered into the aforesaid compromise freely and voluntarily and reiterate that they would stand by the terms of the said Joint Memo.
4. In view of the mutual settlement arrived at between the parties as reflected in the above joint memo, proceedings pending against the petitioners on the file of the VI Additional Chief Metropolitan Magistrate, Bangalore, in C.C.No.23008/2011 arising out of PCR No.3846/2011 is hereby quashed and the Petition is accordingly allowed.
