The writ petition has been taken up through video conferencing. It is accompanied with an application for urgency which on consideration is allowed.
Heard learned counsel for petitioner. The notice for opposite party No.1,3,4,5, and 6 has been accepted by learned Chief Standing Counsel. Mr. Rohit Tripathi appears for opposite party No.2.
Writ petition has been filed seeking following reliefs:-
" i- issue a writ, order or direction in the nature of Mandamus commanding the Opposite parties specially Opposite party No. 4 & 5 to make the approval of proposal send by the Opposite party no.6 for new polling booth of the Gram Panchayat Salpur Dhautal, Vikas Khand Paraspur, Tehsil Colonelganj, District Gonda for the purposes of Panchayat Election year 2021, contained as Annexure No.1, in the interest of justice.
ii- issue a writ, order or direction in the nature of mandamus commanding Opposite parties specially Opposite party no.4 & 5 to make the settlement of polling booths in the village Salpur, Dhautal, District-Gonda, according to the report submitted by the authorities concerned dated 15.03.2021, contained as Annexure No.1 to this Writ Petition, in the interest of justice."
Mr. Rohit Tripathi learned counsel for opposite party No.2 on the basis of instructions informs that the question of change of any poling booth can be considered by the District Election Officer till the date of polling.
In this view of the matter, the writ petition is finally disposed of with the observation that the petitioner may approach the opposite party No.2, District Election Officer, District Gonda raising his grievance. In case any such application is preferred, the same shall be considered and decided in accordance with law expeditiously before the polling date.
