Heard learned counsel for the petitioner.
Original Suit No. 163 of 1986 (Ram Narain and another Vs. Kumar) is pending in the court of Civil Judge (Senior Division) Khalilabad in District Basti.
The submission is that the jurisdiction of Khalilabad is now within the district Sant Kabir Nagar and therefore the record of the said suit is to be transferred to Sant Kabir Nagar but despite the fact that other cases have been transferred the file/record of the said case has not been sent.
Petitioner in this regard has also moved an application dated 5.6.2010 before the District Judge, Basti but with no effect.
In view of the aforesaid facts and circumstances, District Judge, Basti is directed to report as to why the record of the aforesaid case is not being sent to the new district.
The report may be submitted latest by Monday ie. 8.10.2012.
Put up on Tuesday ie. 9.10.2012.
Registry is directed to communicate this order to the District Judge by tomorrow ie. 4.10.2012.
