Learned counsel for the petitioners asserts that the notification under Section 6 of the Petroleum and Minerals Pipelines (Acquisition of Right of User In Land) Act, 1962 (hereinafter referred to as the 'Act') was not issued and, therefore, there arises no occasion for issuance of the notice under Section 8 of the Act. Such an averment has not been made in the writ petition.
Shri Prakash Padia, learned counsel has appeared for the Gas Authority of India Limited.
Learned counsel for the petitioners states that petition may be dismissed with liberty to file a fresh petition with better particulars.
This petition is, accordingly, dismissed with liberty aforesaid.
