1. This application has been filed by the applicant (original petitioner) with a prayer to permit him to join the General Manager, Western Railway as party respondent No.8, in Special Civil Application No.18935 of 2011.
2. Heard Mr.Nirav R.Mishra, learned advocate for the applicant, Mr.Neeraj Soni, learned Assistant Government Pleader for respondent Nos.1 and 2 and Mr.Himanshu K.Patel,learned advocate for respondents Nos.3 to
6.

It is submitted by the learned advocate for the applicant that the applicant is occupying a parcel of land that is the subject matter of the petition, which belongs to the Western Railway as the same was acquired in the year 1982. It is submitted that in this view of the matter, the Western Railway would be a necessary party to the petition.
4. Having heard the learned counsel for the respective parties and as the land in question that is the subject matter of the petition, and which is occupied by the applicant belongs to the Western Railway, the prayers made in the application deserve to be granted.
5. Accordingly, the following order is passed;
The applicant is permitted to join the Western Railway through its General Manager as party respondent No.8 in Special Civil Application No.18935 of 2011.
The necessary amendment in the cause title of the petition be carried out, within a period of two days from today.
After the amendment has been made in the cause title, Registry to issue notice to the newly-added respondent No.8, making it returnable on 8-5-2012.
In addition to the normal mode of service, direct service is also permitted,.
The application is disposed of, in the above terms.
