JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) This appeal is preferred against the order dated 22nd June, 2012 passed by the learned Single Judge in Special Civil Application No.6990 of 2004. By the impugned order, the learned Single Judge dismissed the writ petition. The issue before the learned Single Judge was in connection with giving preference to those students who have less merit in comparison to the students who have higher merits, in giving admission in the medical college run by the Surat Municipal Corporation. Learned counsel Mr. D.C. Dave for the appellants states that the concerned students have already passed out their examination and they have become doctors and, therefore, the issue has become academic. He further states that now even the rules have been changed by the Corporation.
Considering the submissions made by the learned counsel for the appellants, in our view, this matter is required to be disposed of as having become infructuous as the concerned students have already passed out their examination long back and the issue has now become academic, which requires no adjudication at this stage. The appeal is disposed of as having become infructuous.
