(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) Appeal be admitted, returnable on 13th February 2012. The appellant is directed to take steps for service of notice of Appeal upon the substituted heirs of the deceased respondent, if not already made.
Order on Civil Application Nos.5690 to 5693 of 2009 Notice upon the respondents including the heirs of the deceased respondent returnable on 13th February 2012. There will be an unconditional stay of the execution of the award impugned for a period of one month from today. If within the said period the appellant deposits the entire awarded amount before the Court below, the stay will continue till the disposal of the Appeal. If the amount is so deposited, the Court below will invest the same in any nationalized bank in a short-term deposit and will go on renewing the same till the disposal of the Appeal.
