The instant application is filed requesting condonation of delay of 40 days caused in preferring the First Appeal.
Heard Mr.AR Mehta, learned advocate for the applicant. The reasons as to why the delay came to be caused have been set-forth in this application, which are supported by the affidavit of the Officer of the applicant. Considering the facts and circumstances of the case, the delay appears to have been sufficiently explained and, therefore, the delay deserves to be condoned.
For the foregoing reasons, delay of 40 days caused in preferring the appeal is condoned. Rule is made absolute.
