JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE AKIL KURESHI)
1. Rule.
Learned Advocate Mr. Yatin Soni waives service of notice of rule on behalf of the opponents original claimants in all civil applications.
2. Civil Applications are taken up for hearing forthwith. Civil Applications have been filed by the State and its authority seeking stay against impugned judgment and award of the reference court which has been challenged in First Appeal No. 110 of 2012 to 119 of 2012. Such appeals came to be admitted by Division Bench of this Court by an order dated 18.1.2012.
3. It is stated by the learned A.G.P. and with respect to which there is no dispute raised by the learned counsel for the respondents original claimants that entire amounts awarded by the Reference Court along with interest and costs has already been deposited before the Reference Court.
4. In respective cases, out of the amount so deposited, 50 per cent shall be permitted to be withdrawn unconditionally by the claimants which disbursement shall be made through account payee cheque after due verification. Remaining 50 per cent in respective cases shall be invested in fixed deposit in any nationalized bank initially for a period of three years. Such investment shall be renewed from time to time till final or further orders in these appeals. No premature withdrawal of such deposits shall be permitted without the permission of the Court.
5. With above directions, these civil applications are disposed of. Rule is made absolute to the above extent.
