Counsel for the applicant Mr. Trivedi stated under the instructions that the entire amount awarded by the Reference Court along with proportionate interest and cost has been deposited before the trial court pursuant to order dated 11.1.2012 passed by this Court.
From out of the amount deposited by the applicant, it would be open for the claimants to withdraw 50 per cent without any security. Remaining 50 per cent amount be deposited by the trial court in any nationalized bank initially for a period of five years, to be renewed from time to time till the disposal of the appeal.
With above direction, stay granted earlier is confirmed. This civil application is disposed of accordingly.
