JUDGMENT / ORDER

Ramachandran Nair, J.
The learned Ombudsman has submitted Report No.72/2014, with regard to the appointment of lecturers in the colleges under the corporate management of Cochin Devaswom Board. We are concerned only with the post of Assistant Professor in the subject of Economics in Vivekananda College, Kunnamkulam. It is pointed out in the report in paragraph 6 that the selection list is prepared giving first rank to Smt.Smitha P.V. after taking into account her Ph.D. Degree. It is reported that additional ten marks have been awarded to her at the time of interview and the question now raised is whether it could be considered since the award of Ph.D. is after the last date of receipt of application prescribed in the notification.
2. The learned Standing Counsel for the Cochin Devaswom Board submitted that there is no legal embargo in considering the qualification acquired, namely Ph.D. and awarding the marks.
3. The learned counsel appearing for the candidate Sri.V.A.Muhammed also submitted that there is no legal embargo on the same.
4. We heard the learned Standing Counsel for the University also, apart from the learned Government Pleader and the learned counsel for the learned Ombudsman.
5. Since the appointment requires approval from the University, it will be open for the University to consider all these matters in the light of the relevant provisions of the University Act and the Statues concerned. We, therefore, permit the Board to make appointment and place the papers before the University for approval. All the legal issues are left open.
