Heard counsel for the petitioner, learned standing counsel appearing for respondent no. 1 & 2 and Sri Manu Singh representing respondent no. 3.
The present writ petition has been filed for quashing the order dated 11.12.2017 passed by Additional Commissioner -respondent no. 1 in Appeal No. C-20171800955, Ajay Kumar Gaur Vs. State of U.P., filed under section 13(1) of the U.P. Essential Commodities Order, 2016, whereby appeal preferred by respondent no. 4 has been allowed and the order dated 13.7.2017 passed by the District Supply Officer cancelling the license of fair price shop of respondent no. 4, has been quashed.
Learned counsel for the petitioner does not dispute the fact that petitioner is a subsequent allottee and the writ petition at his instance is not maintainable.
The writ petition is accordingly dismissed as not maintainable. No order as to costs.
