1. This application was listed peremptorily today. Earlier, on two occasion application was listed. On 13.8.2018, counsel for applicant sought adjournment on the ground of illness. He was accommodated and matter was directed to be taken up on 23.9.2019. On 23.9.2019, again adjournment was sought on the ground of illness. Then this Court passed following order:
"1. Sri Amit Srivastava, learned counsel for applicants has sought adjournment on account of illness.
2. Passed over for the day.
3. List peremptorily in the next cause list."
2. Today also a request for adjournment on the ground of illness has been made. Since, learned counsel for applicant has sought repeated adjournment. It is a matter of 1999. In these circumstances, I reject the request for adjournment.
3. Called in revise. None appeared on behalf of applicant to press this application. Learned AGA is present for respondents.
4. It appears that by efflux of time either cause of action is no more surviving or for any other reason matter has rendered infructuous and that is why none is present to press this application.
5. Dismissed accordingly.
