The court below was not justified in dismissing the application to re-open the evidence and to receive documents produced by the plaintiff. No prejudice would be caused by affording the parties an opportunity to place their case in full for a decision on merits. I however caution that the proof of the documents produced or its relevancy to the issues framed are matters to be considered by the court below.
2. I set aside the order and allow I.A. No. 520/2014 in O.S. No. 565/2011 on the file of the Court of the Munsiff of North Paravur. The court below is directed to proceed with the suit and make every endeavour to complete the trial within a period of six weeks.
The Original Petition is allowed.
