The petitioner has approached this Court seeking for some time to file an appeal against Ext.P1 proceedings of the Commercial Tax Officer, Pala, which was issued on 18.1.2013 and in the mean time, the petitioner is faced with Revenue Recovery Proceedings.
2. Learned Government Pleader submits that apparently, there is delay in filing an appeal. It is also submitted by the learned Government Pleader that the petitioner had remitted certain amounts pursuant to Ext.P2. Under such circumstances, the petitioner seeks for keeping in abeyance the Revenue Recovery Proceedings to enable him to prefer an appeal before the Appellate Authority.
3. Having regard to the nature of claim made by the W.P.(C) No.26283 of 2014 -: 2 :-
petitioner, I am inclined to grant some time to the petitioner to prefer an appeal before the Appellate Authority and obtain appropriate orders thereon.
Hence, this Writ Petition is disposed of, granting 15 days time from today to the petitioner to prefer an appeal with necessary application to condone delay. In the mean time, the Revenue Recovery Proceedings shall be kept in abeyance for a period of 30 days from today.
