Petitioner is the holder of passport. In the passport, place of birth is shown as Ernakulam. According to the petitioner, his place of birth is Kuwait. Petitioner relies on Ext.P2, birth certificate. However, passport issuing authority refused to consider petitioner's request for correction. Accordingly petitioner approached this Court.
2. Learned Assistant Solicitor General of India points out that petitioner was well aware about the place of birth. The document now relied by the petitioner was in his possession at the time of applying for passport. Passport was originally issued in the year, 2010 and petitioner has an opportunity to produce this document while applying for the passport.
3. Passport issuing authority has power to correct the passport regarding entry relating to place of birth. It is stated in Passport Manual 2010 that however when such change is sought to be made from one State to another, or from India to abroad or vice versa, the case should be examined thoroughly and properly contested in the Court. Therefore passport authority insists for a W.P(C).No.32587 of 2014W 2 genuine and valid reason to correct the place of birth. Petitioner has to establish his reasons by producing valid documents and also filing an affidavit before the Passport Issuing Authority. Passport Issuing Authority shall verify the genuineness of the claim of the petitioner. Needful shall be done within a period of four weeks from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of. No costs.
