JUDGMENT / ORDER

Petitioners are accused Nos.4 and 3 respectively in Crime No.509 of 2014 of the Varkala Police Station for the offences punishable under Sections 143, 147, 148, 294(b), 452 & 324 read with Section 149 of the Indian Penal Code, Section 27 of the Arms Act, apprehend arrest and have filed the application. 2. Learned Public Prosecutor has opposed the application. It is submitted that on 20.04.2014 at about 8.45 p.m. these accused and others trespassed into house of the de facto complainant and attacked him with chopper, iron rod, sword etc. The 2nd and 3rd accused used chopper and iron rod. There is also an allegation that the 4th accused collected chopper from the 2nd accused and attacked the de facto complainant. These accused are involved in two other crimes.

3. Learned counsel submitted that the allegations are not true and that some of the accused sustained injuries. The accused were attacked by the de facto complainant.
4. In the nature of allegations made against the petitioner and the investigation required to be done, request for pre-arrest bail cannot be allowed.
5. It is directed that in case these accused are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
The application is disposed of as above.
