Heard the applicant in person and Sri Sudhir Mehrotra, learned Special Counsel.
Sri Jitendra Singh has put in appearance on behalf of the opposite party no. 2.
Sri Sudhir Mehrotra has filed instruction which is taken on record.
Present application has been filed for wilful disobedience of the order dated 57 of 2018 (Amit Chaudhary vs. Judge Family Court / F.T.C. Agra and another). Operative portion of the aforesaid order is quoted as under:-
"Having due regard to the facts and circumstances of the case, the writ petition being devoid of merit is dismissed. The court below is directed to proceed and decide the Misc. Case No. 5624 of 2016 pending before the Judge Family Court/FTC, Agra expeditiously."
On the strength of the information received from the opposite party no. 1 Sri Sudhir Mehrotra, learned counsel appearing on her behalf has stated in categorical terms that order of this Court has been complied with and order dated 25.2.2019 has been passed.
In the explanation of the Officer concerned it has been mentioned that she was on medical leave because of her retina detachment from 4.12.2018 to 21.12.2018 and thereafter due to eye operation from 2.1.2019 to 13.2.2019 she was on leave. Τhereafter, she has decided the case.
Explanation submitted is accepted. Order of this Court has been complied with, which is not in dispute. Notice stands discharged.
Accordingly, no further orders are required to be passed in the present application and the same is consigned to record.
