Heard Sri Somendra Singh, learned counsel for the petitioner.
The present petition under Article 227 of the Constitution of India has been filed seeking a direction to the trial court to conclude the trial of Case No.306 of 2019 (CNR-UPAU- 020008162019), (Smt. Deepika Shukla vs. Anuj Kumar Shukla), under section 125 of Criminal Procedure Code, 1973, pending before the Principal Judge, Family Court, Auraiya, within stipulated time.
Learned counsel for the petitioner has referred to the order sheet of the case, a copy whereof has been appended alongwith the petition, to submit that the matter is pending since the year 2019 and despite various dates having been fixed, the case is being adjourned for some reason or other and the delay in disposal of the proceedings is causing undue hardship to the petitioner.
Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present petition is disposed of with an observation that the court below would make an endeavour to decide the aforesaid case in accordance with law as expeditiously as possible, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
