Heard Sri Mohit Singh, learned counsel for the applicants and the learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed by the applicants with a prayer to quash the charge-sheet no. 81 of 2018 dated 10.5.2018 arising out of Case Crime No. 0318 of 2017 as well as cognizance order dated 31.05.2018 and order dated 12.04.2019, whereby by Non-bailable warrant has been issued and proceedings of CNR No. UPME40377779-2018 (State Vs. Aditya Sanghi), under Sections 498A, 323, 504, 506, 406 IPC and 3/4 D.P. Act, Police Station Lalkurti, District -Meerut pending in the court of Additional Chief Judicial Magistrate, 5th, Meerut.
As per the description of the applicant mentioned in the application, the applicant-Deepika Sanghi @ Deepika Gupta @ Arti is presently residing in United States of America. Vakalatnama filed in this case has not been authenticated by the concerned Embassy, therefore, the present application is not maintainable.
Sri Mohit Singh, learned counsel for the applicant submitted that he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to file a fresh application.
In view of above, the present application is dismissed as withdrawn with aforesaid liberty.
